The petitioner is apprehending his arrest in connection with Araria (Bairgachhi) P.S. Case No. 525 of 2001 for the offences instituted under Section 420 of the Indian Penal Code. As per the complaint case, the accused got executed three illegal sale deeds with regard to plot no.2211 but in fact the plot number was earlier divided between the co-sharers and co-sharers sold their lands in the year 1969 and this petitioner assisted in executing the forged and fabricated sale deeds. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has falsely been
Patna High Court Cr.Misc. No.27371 of 2016 (2) dt.12-07-2016 implicated in the present case. The matter relates to sale and purchase of the land, hence it relates to civil dispute. After investigation, the police has also submitted a final form against the petitioner which is evident from Annexure-2 to the present application.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Araria(Bairgachhi) P.S. Case No. 525 of 2001 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Manu, Judicial Magistrate, Ist Class, Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
