JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks bail in connection with Phulparas P.S.Case No. 168 of 2018 registered under Sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation is of recovery of 483 litres of liquor from a vehicle and petitioner was arrested there and it further appears that petitioner is accused in two other cases of similar nature. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and petitioner has been named only on confessional statement of co-accused and he is in custody for more than two months. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to

Patna High Court Cr.Misc. No.76485 of 2018(2) dt.21-12-2018 2/2 the petitioner. Accordingly, prayer for bail of the petitioner is rejected. However, trial court is directed to expedite the trial and conclude the same within a period of four months from the date of receipt of a copy of this order. If trial is not concluded within the stipulated period, petitioner will have liberty to renew his prayer of bail.
