The petitioner apprehends his arrest in Saharsa P.S. Case No. 176/2015, registered for the offences punishable under Section 384, 386, 387 and other sections of the Indian Penal Code. The allegation against the petitioner and other accused persons is that while the informant was constructing wall and room on his land, the petitioner and others went there demanded extortion and petitioner is said to have took out wallet from the pocket of the informant containing amount of Rs. 25,000/-. It is submitted that there is a land dispute between the parties, but no paper is attached showing any sorts of land dispute between the informant and any of the accused. The witnesses have also stated that the petitioner demanded extortion and took out

Patna High Court Cr.Misc. No.40688 of 2015 (3) dt.09-11-2015 2/2 wallet from the pocket of the informant.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
