The petitioner apprehends his arrest in Makhdumpur P.S. Case No. 212 of 2016 instituted for the offence under Section (s) 409, 420 of the Indian Penal Code. It is alleged against the petitioner that petitioner being Panchayat Secretary did not submit the folders regarding Technical and Educational qualification of Panchayat teachers of Makhdumpur block for verification before the Vigilance Investigation Bureau.

It has been submitted that petitioner was not posted in Makhdumpur block during the periods 2003-06, 2008-10

Patna High Court Cr.Misc. No.8209 of 2017 (2) dt.27-02-2017 2/2 and 2012 for which the certificates of the Panchayat Teachers are being demanded for verification. It has further been submitted that other accused has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 49305 of 2016 on 09.12.2016. In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Makhdumpur P.S. Case No. 212 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
