The opposite party was granted bail by this court vide order dated 06.01.2012 passed in Cr. Misc. No. 41549 of 2011 in Naya Ram Nagar P.S. Case No. 136 of 2011 but State has filed this petition for cancellation of bail granted to opposite party in above stated Naya Ram Nagar P.S. Case No. 136 of 2011 on the ground that on being released on bail, opposite party committed almost similar type of offence for which Kasim Bazar P.S. Case No. 185 of 2013 was registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b) a, 26, 35 of the Arms Act.
It is surprising enough that the aforesaid Kasim Bazar P.S. Case No. 185 of 2013 was registered on 20.11.2013 and the
Patna High Court Cr.Misc. No.40571 of 2015 (2) dt.04-11-2015 2/2 State woke up near about after one and half years of institution of above stated case and filed petition for cancellation of bail which was granted to opposite party in the year 2012. Accordingly, I do not find any ground in this petition and hence, this petition for cancellation of bail stands rejected. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
