JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioners seek bail in connection with Shambhuganj P.S.Case No. 209 of 2018 registered under Sections 307, 323, 341, 379, 435 and 448/34 of the Indian penal Code. Allegation against the petitioner and other co-accused persons is that they entered into the house of the informant and committed loot and assaulted Md. Naushad from the butt of pistol and also looted Rs. 50,000/- .

Submission of learned counsel for the petitioners is that there is case and counter case between the parties, both sides received injuries and petitioners are in custody for more than three months.

No.76491 of 2018(2) dt.21-12-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Shambhuganj P.S. Case No. 209 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
