The petitioner seeks bail in Gopalpur P.S. Case No. 186 of 2018 instituted for the offence under Section 392 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. There is no recovery of any incriminating article from his possession. He is in custody since 31.7.2018. Counsel for the petitioner further submits that petitioner has been implicated in the instant case due to village politics. Co-accused Manjeet Kumar has already been granted bail by this Court vide order dated 12.12.2018 passed in Cr. Misc. 74376 of 2018.
Patna High Court Cr.Misc. No.77305 of 2018(2) dt.21-12-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Gopalpur P.S. Case No. 186 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
