JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-12-2021 The present petition is by way of second attempt at the behest of the petitioner for grant of anticipatory bail in connection with Special Case No. 320 of 2019 (arising out of Digha P.S. Case No. 384 of 2019) for the offences punishable under Section 135 of the Electricity Act inasmuch as the earlier prayer of the petitioner for grant of anticipatory bail was rejected by this Court vide order dated 11.09.2020 passed in Criminal Misc. No. 17111 of 2020.

The learned counsel for the petitioner has submitted that the petitioner has approached this Court in a changed scenario inasmuch as the petitioner is ready to deposit a sum of Rs. 4,00,000/- upfront i.e. more than 50 per cent of the amount of loss caused to the electricity company i.e. Rs. 7,89,056/-.

No.64798 of 2021(2) dt.01-12-2021 2/2 The learned counsel appearing for the respondent Electricity Company has no objection but submits that he may at least make the aforesaid payment of Rs. 4,00,000/- in one lump sum and the rest of the loss amount be made subject to the final outcome of the case.

Having heard the learned counsel for the parties and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to admit the petitioner to the privilege of anticipatory bail, however, subject to the petitioner depositing a sum of Rs. 4,00,000/- with the Executive Engineer, Electric Supply Division, Digha within a period of four weeks from today and producing the receipt thereof before the learned Court below and further subject to furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, P.E.S.U., Area, Patna in connection with Special Case No. 320 of 2019 (arising out of Digha P.S. Case No. 384 of 2019 as also subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
