The petitioner seeks regular bail in connection with Excise Case No. 237 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 165 litres of illicit liquor from a hut belonging to the joint family of the petitioner.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, nothing incriminating has been recovered from the conscious possession of the petitioner and there is no compliance of Section 100 Cr.P.C. as far as the seizure list is concerned. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-3rd-cumSpecial Judge Excise, Samastipur in connection with Excise P.S. Case No. 237 of 2018.
