JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Bihar P.S. Case No. 193 of 2015 for the offences instituted under Sections 419 and 420/34 of the IPC.
The prosecution story, in brief, is that Sachin Kumar, I.T. Incharge, Regional Office, Biharsharif, Rakesh Kumar, Assistant Manager, Branch-Biharshariff and Santosh Kumar Choudhary (petitioner), Assistant Manager, Regional Office, Biharsharif, committed some fraudulent act in nine account holders of the bank by computer and by making forged account holders and withdrew Rs. 13,42,000/- fraudulently in connivance with each other. The
Patna High Court Cr.Misc. No.39718 of 2015 (2) dt.01-10-2015 2/3 informant has made an enquiry and the copies of written statements of the aforesaid three accused persons alongwith other persons and copies of cheques by which the amounts have been withdrawn fraudulently have been attached with the written report. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is an Assistant Manager in the Bank. From perusal of enclosure at page 45 of the bail petition, it appears that the misappropriated amount Rs. 13,42,000/- has already been deposited with the Bank. It is further submitted that the petitioner is ready to deposit an amount of Rs. 15,000/- in the court below which shall be subject to final disposal of the case On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 15,000/- in the court below which shall be subject to final disposal of the case and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Bihar P.S. Case No. 193/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.39718 of 2015 (2) dt.01-10-2015 3/3 amount each to the satisfaction of the learned C.J.M., Nalanda at Biharshariff, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
