This application, for grant of anticipatory bail, arises out of Rajauli Police Station Case No. 02 of 2017, disclosing offences under Sections 461, 379 of the Indian Penal Code and later on Section 457 and 380 was added. The allegation against the petitioner is that he committed theft of some article, in a school, named, Sarswati Shishu Mandir.
The learned counsel for the petitioner has submitted that during investigation, no incriminating evidence emerged against the present petitioner except the confessional statement of co-accused, Ranjan Kumar@ Ranjan Thathera @ Bandar in Rajoi P.S. Case No.322 of 2016. He has also submitted that the
Patna High Court CR. MISC. No.9928 of 2021(2) dt.22-12-2021 2/2 petitioner has no criminal antecedent.
Learned Addl. P.P. has opposed and the prayer for bail.
Considering the aforementioned fact and circumstances, let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Rajauli Police Station Case No. 02 of 2017, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
