2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

3. The petitioners seek bail in connection with Singhiya PS Case No.46 of 2025 dated 24.03.2025, instituted for the offence punishable under Sections 25(1-B)a, 26, 35 of the Arms Act.

The case of the prosecution, in brief, is that the informant, who is the Officer-in-Charge of Singhia PS, got secret information that some unknown miscreants have assembled at Kareh Bandh near village Basua. On such tip off, he along with other police personnel reached there and found four persons were there and they were gossiping. On seeing the police party, all of them tried to flee away but with the help of police personnel, one miscreant was caught and he disclosed his name as Parwez Alam and also disclosed the name of the petitioners and one Shiv Kumar Rai, who fled away from the place of occurrence. One countrymade pistol was recovered from the possession of Parwez Alam, who was apprehended at the spot. Later on, petitioner, Raushan Choudhari @ Raushan Kumar Chaudhari @ Raushan Chaudhary @ Raushan Kumar Chaudhary, was also arrested from his house but nothing was recovered from his possession.

5. Learned counsel for the petitioners submits that the apprehended person, Perwez Alam, disclosed the name of the

Nothing incriminating has been recovered either from conscious possession or from the house of the petitioners. They have falsely been implicated in this case due to village politics. Further submission is that petitioner Pankaj Kumar Ray @ Pankaj Ray @ Pankaj Kumar Singh (Cr. Misc. No.52414 of 2025) is in custody since 25.03.2025 and one case under the Excise Act is pending against him and petitioner Raushan Choudhari @ Raushan Kumar Chaudhari @ Raushan Chaudhary @ Raushan Kumar Chaudhary, (Cr. Misc. No.53420 of 2025) is in custody since 24.03.2025 having clean antecedents.

6. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Rosera, Samastipur, in Singhiya PS Case No.46 of 2025.

8. The applications stand allowed.
