The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 414, 467, 468, 471, 420/ 34 of the Indian Penal Code and Sections 30(a), 41(i)(ii) of the Excise Act.

The learned counsel for the petitioner submits that the petitioner has antecedent of three cases and the allegation is of recovery of 2852.23 litre of liquor from a Tata Magic. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. His name transpired in the confessional statement of co-accused Manoj Kumar Singh, which has no evidentiary value. It is submitted that the petitioner is not the owner of the Tata Magic.

Patna High Court CR. MISC. No.63737 of 2021(2) dt.24-06-2022 2/2 Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Ujjiyarpur P. S. Case No.90 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
