The present modification application has been filed for modify the order dated 22.07.2020 for extension of time passed in Cr. Misc. No. 20747 of 2020.
Learned counsel for the petitioner submits that the Hon'ble Court has directed the petitioner that he will surrender within a period of four months but the petitioner did not surrender due to COVID-19 effect and after that the petitioner is suffering from illness.
The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and
Patna High Court CR. MISC. No.56416 of 2022(2) dt.01-11-2022 2/2 submits that the privilege of bail granted by the petitioner vide order dated 22.07.2020 and the petitioner has filed present modification on 17.10.2022. He further submits that petitioner has admitted in the hospital on 10.12.2021 and discharged on 11.12.2021 but he did not disclose that where he was from 22.07.2020 to 09.12.2021.
Considering the aforesaid facts, I am not inclined to modify the order dated 22.07.2020 passed in Cr. Misc. No. 20747 of 2020.
Prayer is refused.
Accordingly, this modification application stands dismissed.
