2. The petitioner has preferred this application for grant of regular bail in connection with S.T. No. 104/2024 arising out of Kharagpur P.S. Case No. 641/2023 dated 07.11.2023 registered for the offence punishable u/s 341, 323, 504, 506, 324, 307 and 379 read with 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have assaulted the informant and her family members. In the meantime, the petitioner inflicted blow of knife on the hydrocele, causing injury. Further, the co-accused, Kallu Tanti assaulted the informant with fist,

Patna High Court CR. MISC. No.57275 of 2024(2) dt.21-08-2024 2/3 causing injury and the co-accused Kampani Tanti assaulted her with the butt of pistol. Thereafter, the co-accused Pawan Tanti assaulted the informant and her husband with lathi, causing injury. The co-accused Meena Devi snatched golden ear-ring of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is a case and counter case between the parties. From the perusal of the FIR, the date of occurrence is 01.11.2023 but FIR has been lodged on 07.11.2023. As per annexure-2, the injury is (2 x 05 x 0.1)cm incised wound on scrotal area(left). Further, no other abrasion external injury present on any spirit of body. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.11.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the injury is dangerous to life.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
