The petitioner apprehends his arrest in Sonebarsa P.S. Case No. 102/2016 registered under Sections 341, 323, 324, 504, 506, 354(B), 379/34 of the Indian Penal Code. The informant Asharfi Mahaseth named the petitioner Chandradeo Mahaseth, his son Vikash Kumar, and his wife Nirmala Devi and alleged that they all assaulted the informant. When the wife of the informant came to rescue him, they also assaulted her. Chandradeo Mahaseth (the petitioner) is alleged to have assaulted the informant with Dabiya on his head and snatched Rs. 20,000/- from the possession of the informant. Learned counsel for the petitioner submits that Sonebarsa P.S. Case No. 103/2016 is the counter-version which was registered on the basis of the Fardbeyan of Nirmala Devi, wife of the petitioner.

Considering the fact that there is case and counter case and the informant and his wife sustained simple injuries, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Sonebarsa P.S. Case No. 102/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
