2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ), 127 ( 2 ), 115 ( 2 ), 118 (1) , 109, 303 ( 2 ), 191 ( 2 ), 190, 329 ( 4 ), 76, 352 and 351 ( 2 ) of BNS.

3 . As per the prosecution case , all the F.I.R. named accused persons including these petitioners assaulted informant and her family members as a result of which 2 persons sustained injuries.

4. It is submitted on behalf of the petitioners that the

Patna High Court CR. MISC. No.52980 of 2025(2) dt.20-08-2025 2/2 petitioners are innocent and have committed as alleged. Allegation of assasult is general and omnibus. Prior to the loging of present case , petitioner No. 1 lodged a complaint against husband of informant and others i. e ,. Bhopatpur PS Case No. 34 of 2024 and in retaliation this false and concocted case has been lodged against these petitioners and others. Injuries sustained by injured are simple in nature .

5. Learned counsel for the State oppose the bail petition.

6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the JM Ist Class, Motihari East Champaran in connection with Bhopatpur P.S. Case No. 35 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
