C. to A.A.G. 3 In the nature of order this Court proposes to pass it would not require to await filing of the counter affidavit. In short, the grievance of the petitioner is that although he was appointed on the post of Chaukidar vide appointment letter dated 24.11.1981, a copy of which is present at Annexure-1 and has continued on the post all along but suddenly his salary was stopped in April, 2014 on a false complaint filed by his cousin brother questioning his identity as well as his parentage. Patna High Court CWJC No.4212 of 2017 dt.16-11-2017 2/2 had represented before the District Magistrate on 13.02.2017 for release of his salary since he continues to discharge the duty but the same has not been disposed of.

Having heard learned counsel for the parties and considering the nature of grievance raised herein, for the present, I deem it proper to direct the District Magistrate, Gaya to consider the grievance of the petitioner as raised in his representation at Annexure-9 and also taken note of hereinabove and dispose of the same in accordance with law with opportunity of hearing to the petitioner preferably within a period of three months from the date of receipt/production of a copy of this order.

The writ petition is allowed.
