The petitioner apprehends his arrest in connection with Barachatty (Mohanpur) P.S. Case No.798 of 2018 registered under Sections 302, 201 and 120(B) of the Indian Penal Code. The accusation is that Rahul Kumar, the son of the informant, received call on his mobile. After short interval, Rohit Kumar took Rahul Kumar on Glamber vehicle. Before six months, Pana Yadav, Surendra Yadav alias Hauwa Yadav, Gauri Yadav and Saryu Yadav had assaulted Rahul Kumar mercilessly and had given threatening to kill him. While the panchayati was arranged but they gave threatening to kill the son of the informant. The informant raised suspicion about having their hand in committing the murder of his son and throwing his dead body in the river.

In course of investigation, the informant and his wife raised suspicion against the petitioner having hand in the murder of his son saying that their son had illicit relation with the wife of the petitioner. Except that, in course of investigation, no material could be collected by the Investigating Officer against the petitioner. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sherghaty (Gaya), in connection with Barachatty (Mohanpur) P.S. Case No.798 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
