The petitioner apprehends her arrest in Excise Case No.332 of 2019 registered under Section 30(a) and 56(b) of Bihar Prohibition and Excise Act.

The police intercepted a motorcycle but driver of the motorcycle fled away. From the bag tied on the motorcycle, 10 liters country made liquor was recovered.

The learned counsel for the petitioner submits that petitioner is a lady. Her brother-in-law was driving the motorcycle. Petitioner stated in para 10 of the bail petition that her brother-in-law was driving the motorcycle. Petitioner is only the name lender. Owner book is standing on the name of the petitioner.

No.54467 of 2019(2) dt.30-08-2019 2/2 Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Excise Case No.332 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
