JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-08-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For direction/order to the respondent No.2 the Collector-Cum-District Magistrate, Sitamarhi to set up an enquiry against the conduct of Circle Officer, Sursand and the Officer-in-Charge, Sursand who are sitting iddle on the point of demolition of her (Petitioner No.1) house constructed on self purchased land property without any injury caused to the other Private respondents and the private respondents have taken the law in their hand when the dwelling house constructed on her (Petitioner no.1) own land property has been demolished in collusion with the local authorities.

Patna High Court CWJC No.14018 of 2022(4) dt.28-08-2023 3/3 (ii). For the Direction/Order to the state respondents concern to restore the dwelling house similar as she constructed on herself purchased land (Pucca house).

(iii). For the Direction/Order to the Private Respondents No.10 to 26 to pay the compensation to the petitioners with the other needful legal assessed amount as the cost of harassment and defamation in the society."

After some arguments, the learned counsel for the petitioners seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioners to avail such other alternative remedies as are otherwise available under the law including that of filing a civil suit before the learned Civil Court having competent jurisdiction. Liberty, so sought, is granted. 3.
