The petitioner has preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code and sections 25 (1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, on information having been received by the informant that accused persons have gathered and may give effect to an occurrence, it is stated that a raid was conducted. On search one loaded country made pistol with four live cartridges were found in possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the FIR, together with the petitioner having been remained in custody for 10 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Jogbani (Bathnaha) P.S. Case no. 116 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria.
