1. At the outset, the learned counsel for the opposite parties submits that in compliance of the order of this Court dated 21.07.2022, passed in C.W.J.C. No.6988 of 2022, the Circle Officer- Kudra, Kaimur has passed the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 on 02.08.2022, however it is the complaint of the petitioners that no notice was given to the petitioners, hence they were

Patna High Court MJC No.1819 of 2022(3) dt.11-07-2025 2/2 precluded from filing any effective show cause prior to passing of the aforesaid order dated 02.08.2022, nonetheless, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to challenge the aforesaid order dated 02.08.2022, by availing such remedies as are otherwise available under the law, however seeks liberty to raise the aforesaid issue as well in appeal. Liberty so sought is granted.
