Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a),32(ii) of Bihar Prohibition and Excise Act, 2018.
From the outer house and from a ditch near the house of the petitioner liquor was recovered and it is said that the same was of the petitioner. Petitioner is in custody since 25.11.2020. Investigation of the case is already complete. Petitioner has got no criminal antecedent under Bihar Prohibition and Excise Act. Submission is that place of recovery is accessible by anyone and everyone.
Let the petitioner, above named, be released on bail
Patna High Court CR. MISC. No.10407 of 2021(2) dt.01-07-2021 2/2 on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Daraunda (M.H. Nagar) Police Station Case No.49 of 2020 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
