JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 This application, for grant of anticipatory bail, arises out of Rajepur P.S. Case No. 75 of 2016, disclosing offences under Sections 143, 427, 353 of the Indian Penal Code. Allegation as per F.I.R. is that large number of accused persons including the petitioner and thirteen F.I.R named accused persons damaged the chair, table window and other Government properties of the office of the B.D.O. Submission of learned counsel for the petitioner he is not named in the F.I.R and has falsely been roped in this case along with several other accused persons. Moreover, no specific allegation has been attributed to the petitioner and with respect to the same occurrence, he has been made accused in several other cases also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, East Champaran, Motihari, in connection with Rajepur P.S. Case No. 75 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
