JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This application, for grant of anticipatory bail, arises out of Valmikinagar P.S. Case No. 68 of 2018, disclosing offences under Sections 409, 420 and 34 of the Indian Penal Code. Petitioner happens to be Executive Engineer of Gandak Project and allegation against him is of paying Rs. 7,41,80,641 without approval, which is more than the approved amount. Submission of learned counsel for the petitioner is that on the order of Chief Engineer, he has passed the bill and other accused persons have been granted privilege of anticipatory bail vide order dated 31.01.2019 passed in Cr. Misc. No. 80115/2018 and vide order dated 27.06.2019 passed in Cr. Misc. No. 39485 of 2019. Heard learned A.P.P. also.
Having heard both sides, in vie of the above facts, let petitioner, above named, surrender before the court below within
Patna High Court CR. MISC. No.57883 of 2019(4) dt.23-09-2019 2/2 four weeks, on which, he will be released on provisional bail till submission of chargesheet on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Bagha, in connection with Valmikinagar P.S. Case No. 68 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and with further condition that he has to appear before the investigating officer and will produce all the necessary documents, which will be scrutinized by the Investigating Officer, however, even after that if the charge-sheet is submitted against the petitioner, he will have to surrender and pray for regular bail, which will be considered on the basis of materials available against him at that time.
