Parmanand Prasad, APP for the State.

The petitioner herein seeks anticipatory bail in Maniyari P.S. Case No. 76 of 2014, registered under Sections 25(1-b)A, 26, 35 of the Arms Act.

On a search carried out by the informant, one accused person was arrested with fire arms. Others managed to escape. On the statement the possession of the arrested person the name of the petitioner transpired. Accordingly, he has also been named as an accused.

Indisputably, no seizure of fire arm was made from the possession of the petitioner. Only on the strength of statement of co-accused he has been named accused in the present case. It is

Looking to the allegations and other materials available on record, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in Maniyari P.S. Case No. 76 of 2014 subject to the condition that one of the bailors shall be his own/close family member. The petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
