2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 126(2), 115(2), 109(1), 308(3), 352, 351(2) and 3(5) of B.N.S & 27 of Arms Act.
3. The case of the prosecution is that the petitioner along with others has made five round firing on the informant and one of the fire hit in his right knee due to which, he received gun shot injury on leg.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the nature of allegation is general and omnibus and from perusal of the injury
Patna High Court CR. MISC. No.52880 of 2025(4) dt.05-12-2025 2/2 report, it will transpire that the informant has received simple injury caused by hard and blunt object. Moreover, the petitioner is languishing in judicial custody since 21.03.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Cheriya Bariyarpur P.S. Case No. 35 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge cum A.C.J.M., Manjhaul, Begusarai.
