JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-08-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,324,307,384,506 and 120B/34 of the Indian Penal Code.

The prosecution case is that on 20.4.2015 at 5 P.M. when the informant was returning home from the market, three persons namely Bipin Yadav, Suraj Kumar and Ajit Kumar stopped the motorcycle of the informant and threatened for not making payment of extortion amount demanded by the petitioner. Thereafter co accused Bipin Yadav fired causing injury on the arm of the informant whereas the firing made by Suraj did not hit the informant. The motive of the occurrence is that the petitioner earlier demanded five lacs rupees as extortion which was refused by the informant when threatening was given to him.

Patna High Court Cr.Misc. No.30849 of 2016 (2) dt.03-08-2016 2/2 It is submitted by the learned counsel for the petitioner that admittedly the petitioner was not on spot nor there was any overt act alleged against the petitioner.

Though admittedly the petitioner was not on the spot nor any overt act has been alleged against him but since the motive of the occurrence is alleged to be extortion demand made by the petitioner and considering the criminal antecedent of the petitioner, let the learned court below consider the prayer for regular bail of the petitioner in case he surrenders within six weeks from today in connection with Munger Mufassil P.S. Case No. 71 of 2015 pending in the court of learned S.D.J.M. Sadar, Munger. This application is disposed of with the aforesaid observation/direction.
