====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 15-06-2022 Heard learned counsel for the parties.
Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioner seeks anticipatory bail in connection with complaint Case No. 771C of 2020 registered for the offence under Sections 498A/34 of the Indian Penal Code. The main submissions advanced by learned counsel for the petitioner are that the petitioner is father-in-law of the complainant and the allegation made in paragraph no. 8 of the complaint is completely improbable and unbelievable and husband of the complainant is always ready to keep his wife in his company and the complainant's marriage was solemnized on
Patna High Court CR. MISC. No.63564 of 2021(2) dt.15-06-2022 2/2 1.9.2018.
Learned counsel for the informant as well as learned APP has vehemently opposed the bail petition and submitted that against the petitioner there is specific allegation and he instigated the complainant to commit suicide by hanging. Having Considered the above submissions and mainly the fact that the petitioner has a relationship of father-in-law with the complainant and in the course of hearing learned counsel for the complainant denies to have any evidence with regard to the alleged physical cruelty, in my view lenient approach can be taken let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Court concerned in connection with complaint Case No. 771C of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
