====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2023 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 379, 341, 342, 323, 427, 504, 506, 147, 149 of the Indian Penal Code.

3. As per prosecution case, on the alleged dated and time of the occurrence, all the F.I.R. named accused persons including these petitioners harvested paddy crops from the field of the informant worth Rs. 60,000/- and further destroyed paddy crops worth Rs. 20,000/-

4. Learned counsel for the petitioners submits that all the offences are bailable except Section 379 IPC. He further

Patna High Court CR. MISC. No.55710 of 2023(2) dt.29-08-2023 2/2 submits that informant is in habit of lodging false case as earlier also he has lodged Bikramganj P. S. Case No. 556 of 2019 with similar allegation. Petitioners are gotiyas of the informant and admittedly there is land dispute between the parties. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Bikramganj, Rohtas in connection with Bikramganj P. S. Case No. 39 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
