JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-01-2019 This application, for grant of anticipatory bail, arises out of Sadar (Muffasil) P.S. Case No. 128 of 2016, disclosing offences under Sections 376 and 511 of the Indian Penal Code.
Allegation against the petitioners is of attempt to commit rape on the informant and snatched away golden chain. Submission of learned counsel for the petitioners that they have falsely been implicated in this case and the dispute arose with regard to demarcation of land and the police after investigation submitted charge-sheet only under Sections 504 and 506/24 of the Indian Penal Code, however, the learned Magistrate differing with the opinion of the police has taken cognizance in other sections of IPC also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Six Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar (Muffasil) P.S. Case No. 128 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
