JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 353, 605 of the Indian Penal Code.

The prosecution case is that the informant being Executive Assistant was abused and assaulted in the office of Block Development Officer by co-accused Bidur Kumar. It is alleged against this petitioner that petitioner being brother of co-accused Bidur Kumar was accompanying Bidur Kumar when assault was made.

It is submitted by learned counsel for the petitioner that accusation is not specific against the petitioner and there is counter version of the occurrence also. Considering the fact that petitioner is accused in two other cases, this Court is not inclined to grant privilege of anticipatory bail to him. However, considering the

Patna High Court Cr.Misc. No.41925 of 2015 (2) dt.12-10-2015 2/2 accusation, it is a case for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Shankarpur P.S. Case No. 38 of 2015, pending in the Court of learned Chief Judicial Magistrate, Madhepura.

With the observations above, the application stands disposed off.
