ANJANA MISHRA ORAL ORDER 10-01-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 10.10.2018 in connection with Kawakole P.S. Case No.223 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioners submits that Mahuwa liquor, which was recovered from the motorcycle, was not from the conscious possession of the petitioners, rather the same has been attributed to them as neither the copy of the seizure list has been served upon the petitioners nor has their L.T.I. been taken.

In view of the aforementioned facts and

No.76888 of 2018(2) dt.10-01-2019 2/2 circumstances and that the petitioners are having a clean past, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J. II-cum-Spl. Judge, Nawada, in connection with Kawakole P.S. Case No.223 of 2018.
