2. The petitioner seeks bail in connection with Kotwali P.S. Case No. 55 of 2025 dated 02.02.2025, instituted for the offence punishable under Sections 309(4) of the Bharatiya Nyaya Sanhita.

3. The prosecution case, in short is that on 02.02.2025 at about 03:00 am, the informant along with her nephew was going to her home from railway station by tempo. In the midway, one unknown person came on bullet motorcycle bearing Registration No. BR02 BQ 5375 and parked the motorcycle in front of tempo and stopped the tempo. It is further alleged that accused person started abusing and scuffling with the tempo passengers and allegedly snatched the informant's

No.52684 of 2025(3) dt.15-11-2025 2/3 handbag in which there was one mangalsutra, two pairs of silver payal, two gold tops, head pearl necklace, a pair of artificial rose gold earring, Rs. 700/-. Accused person also snatched a bag from co-passenger namely, Subodh Kumar in which Aadhar Card, Pan Card, ATM Card and Assistant Locopilot Training Booklet were kept.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner has been only made accused in this case only on the basis of suspicion because the alleged motorcycle from which the incident took place was registered in the name of the father of the petitioner. It is next submitted that the snached articles were seized from police campus and not from the possession of the petitioner. No T.I.P. has been conducted till date. Lastly, it has been submitted that the petitioner is in custody since 03.02.2025, he has one criminal case against him and charge-sheet has been submitted in the case.

5. Learned A.P.P. vehemently opposed the prayer for bail of the petitioner and submitted that the motorcycle which was used in the said crime was registered in the name of father of the petitioner. It is further submitted that the snatched articles

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, I am not inclined to grant bail to the petitioner at this stage.

7. Accordingly, the prayer for bail of the petitioner is hereby rejected.

8. However, the learned Trial Court is directed to expedite the trial and take all endeavour to conclude the trial at the earliest, preferably, within a period of nine (09) months from the date of receipt or production of a copy of this order. (Khatim Reza, J) Sankalp/- U T
