JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act, Section 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that on 18.10.2014 while the informant was working in the agriculture filed the accused persons came, started abusing by calling caste name and asked the informant to leave the agricultural field otherwise threatened to kill him. The accused persons also resorted to fire but it die not cause any injury. It is submitted by learned counsel for the petitioners that for the occurrence of 18.10.2014 the First Information Report was registered on 20.10.2014 and in the

Patna High Court Cr.Misc. No.42028 of 2015 (2) dt.13-10-2015 2/2 background of land dispute the accusation has been levelled. The accusation is omnibus and general.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with SC/ST P.S. Case No. 99 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
