JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned Senior counsel for the petitioner and learned counsel for the State.
The petitioner seeks pre-arrest bail in connection with Naubatpur P. S. Case No. 291 of 2014 registered against unknown under Sections 302 and 201 of the Indian Penal Code. It is contended that the petitioner is neither named in the FIR nor any positive evidence could be collected against him during investigation.
On the other hand, learned counsel for the State has opposed the prayer for grant of anticipatory bail to the petitioner. Referring to the impugned order, he has submitted that it has come during investigation that the petitioner was one of the persons
Patna High Court Cr.Misc. No.42479 of 2015 (2) dt.13-10-2015 2/2 involved in the offence.
Be that as it may, regard being had to the serious nature of allegation and the fact that the matter is still under investigation, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the application is rejected.
