JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-03-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in connection with Muffasil P.S. Case No. 165 of 2020, registered for the offences punishable under Sections 341, 323, 325, 326, 448, 34 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation, when the informant, Harinandan Singh, was erecting shade on his wall, the petitioners came there. He has alleged that petitioner No. 1 opened fire but it did not hit the informant. It is alleged further that petitioner No. 1 assaulted the informant with

Patna High Court CR. MISC. No.12022 of 2021(4) dt.08-03-2022 2/2 khanti on his head and petitioner No. 2 and petitioner No. 3 inflicted on the head of the informant's wife with stick. Learned counsel for the petitioners has submitted that there is case and counter case and both the parties have sustained injuries. Learned counsel for the informant has submitted that the accused persons badly assaulted the informant who sustained injuries on his head.

The injury report of the informant has been called for which shows that the injuries are simple in nature. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender, be released on anticipatory bail within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Muffasil P.S. Case No. 165 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
