The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 120B of the Indian Penal Code, 11 of the Gambling Act and 25(1-B)a/26 of the Arms Act.

The prosecution case is that the S.H.O. of Ahiyapur Police Station on receiving secret informant that some persons are gambling in lichi orchard, a raid was conducted when seven persons were apprehended. Upon search country made pistol, mobile, playing card and Rs. 31,900/- were recovered from apprehended accused. The suspicion was raised against the petitioner since his motorcycle was parked there.

Patna High Court Cr.Misc. No.41879 of 2015 (2) dt.12-10-2015 It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 681 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
