Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1B)a, 26, 35 of the Arms Act. The prosecution case is that the informant being a police officer received confidential information that miscreants are planning to commit some crime, when a raid was made and one person namely Arvind Rajvanshi was apprehended, from whose possession one loaded country made pistol was apprehended. The apprehended accused suggested the name of the petitioner as his associate, who escaped from the scene.
Patna High Court Cr.Misc. No.35710 of 2016 (2) dt.02-09-2016 It is submitted by the learned counsel for the petitioner that there is no recovery from the possession of the petitioner and statement has been made in para-3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Rajgir P.S. Case No. 54 of 2016, pending in the court of learned Additional Chief Judicial Magistrate-IV, Nalanda at Biharsharif. With this observation this application is disposed of.
