2. In the present case, the petitioner seeks bail in connection with Nokha P.S. Case No. 189 of 2026 dated 14.05.2026, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109(1), 329(4) and 3(5) of the B.N.S., 2023.
3. As per the prosecution case, petitioner and other co-accused persons armed with lathi, bhala and sharp edged weapons entered into the house of the informant and indiscriminately assaulted the informant and her family members causing a number of injuries to them.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely

There is dispute between the parties for irrigating their fields as the informant's side has been tapping the electricity through a naked wire which was objected by the petitioner's side and this resulted in the alleged occurrence in which both sides received injuries. Learned counsel further submits that the injuries of the informant and her family members are non-serious. Two of the injured persons of the family members have received simple injuries which are merely lacerated wounds. However, fracture of the skull bone of the husband of the informant was found whose injury was stated to be grievous in nature.
However, for inflicting this injury, the allegation is against co-accused Deepak Kumar as the injured himself has stated during investigation that it was Deepak Kumar who assaulted him. There is no specific overt act attributed against the petitioner rather the allegation against him is general and omnibus. Learned counsel next submits that petitioner is having clean antecedent. Learned counsel lastly submits that petitioner is in custody since 15.05.2026.
5. Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the

No.52287 of 2026(2) dt.29-07-2026 3/3 non-specific nature of allegation levelled against the petitioner and also considering his clean antecedent and his period of custody, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Class, Sasaram, Rohtas / concerned Court, in connection with Nokha P.S. Case No. 189 of 2026, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned. (Arun Kumar Jha, J) Shahnawaz/- U T
