The petitioner seeks bail in Habibpur P. S. Case No. 34 of 2017 instituted for the offence under Section(s) 406, 420 and 120B of the Indian Penal Code.

Learned counsel for petitioner submits that in the instant case no TIP has been held. Petitioner has no criminal antecedent.

The informant has alleged that she received call on his mobile by one Chhabi Kant Das for marriage who told that he has been selected as Public Prosecutor in Ranchi and for which he made demand of Rs. 3,60,000/-. The informant has further alleged that he handed over an amount of Rs. 3,00,000/- in cash to Chhabi Kant Das and deposited an

It has further been submitted that petitioner has no knowledge about any Chhabi Kant Das or the talk between the Chhabi Kant Das and informant on mobile. The other co accused of this case has already been granted bail by co-ordinate Bench of this Court by order dated 8.10.2018 passed in Cr. Misc. no. 62391 of 2018. It has further pointed out that entire cheating has been done by said Chhabi Kant Das.

The petitioner is in custody since 22.7.2018 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM XIIth Bhagalpur, in connection with Habibpur P. S. Case No. 34 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.
