The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The prosecution case is that the informant gave Rs.50,000/- to the petitioners on the pretext of providing employment to his son but neither the employment has been provided nor money has been returned.
It is submitted by learned counsel for the petitioners that there is no proof with regard to the payment and even
Patna High Court Cr.Misc. No.45020 of 2015 (2) dt.15-10-2015 2/2 assuming the accusation no offence under section 420 IPC is made out since the informant wanted to get his son employed illegally. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Rohtas in connection with Sasaram (Town) P.S. Case No.30 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
