Patna High Court CR. MISC. No.10343 of 2021(2) dt.22-12-2021 2/3 remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 324, 325, 307, 379, 354(B), 427 and 34 of the Indian Penal Code, registered in connection with Majhaulia P.S.Case No.477 of 2020. Four accused persons named in the first part of the FIR misbehaved with the daughter of the informant and they badly assaulted her. When the informant asked about the occurrence, 21 accused persons named in the FIR including the petitioners badly assaulted the informant and his family members.

The learned counsel for the petitioners has submitted that both sides are agnates and there is also a counter case. He has further submitted that all the injuries are simple in nature, caused by hard and blunt substance, except one grievous injury on the persons of Mohan Das and Shobha Devi. As the author of the injury on the person of Shobha Devi is Yogendra Das, petitioner no.6, his prayer for anticipatory bail is hereby rejected.

No.10343 of 2021(2) dt.22-12-2021 3/3 So far as other petitioners, named above, are concerned, let them in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Majhaulia P.S.Case No. 477 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
