The petitioner is apprehending arrest in a case registered for the offences punishable under sections 399 and 402 of the Indian Penal Code and sections 25(1-B) a, 26 and 35 of the Arms Act.

On information that the miscreants are preparing to commit dacoity, raid was laid when Sanjay Das and Pankaj Kumar were apprehended from whom two live cartridges and cash of rupees forty thousand along with mobile were recovered. The apprehended accused disclosed the name of other accused including the petitioner.

Patna High Court Cr.Misc. No.41338 of 2015 (2) dt.08-10-2015 2/2 It is submitted by the learned counsel for the petitioner that except the disclosure of his name by the apprehended accused, there is nothing against the petitioner nor there is any recovery from the petitioner. More over, the apprehended accused Pankaj and Sanjay have been granted bail vide Cr. Misc. Nos. 10131 and 39520 of 2013.

Considering the aforesaid facts, this court sees no reason for the learned court below not to consider the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Pusa P.S. Case No. 5 of 2013 pending in the court of learned JM Ist Class, Samastipur.

This application is disposed of with the aforesaid observation/direction.
