The petitioner is apprehending his arrest in a case registered under Sections 406, 420, 467, 468, 471 and 120B of the Indian Penal Code.
The informant is the Secretary and the co-accused, Saroj Thakur, is the President of an Non-Governmental Organization. They jointly issued a cheque in favour of the petitioner for the goods supplied by the petitioner. Allegation is that interpolation was made in the cheque by enhancing the amount from rupees two lakh and odd to rupees twelve lakh and odd and the money was withdrawn by the petitioner. Learned counsel for the petitioner submits that it is still a disputed question whether there was any interpolation or not and the prosecution must explain that in fact cheque was of rupees two lakh and odd only.
Let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.33100 of 2016 (6) dt.16-11-2016 amount each in connection with Samastipur (Town) P.S. Case No. 70 of 2016 to the satisfaction of the Chief Judicial Magistrate, Samastipur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
