The petitioner is in custody in connection with Matihani P.S. Case No. 142 of 2018 for the offences under Section 414 of the Indian Penal Code read with Section 25(1A), 25(1-b)A, 26 and 35 of Arms Act. Learned counsel for the petitioner submits that the petitioner has no criminal history and he is in custody since 23.10.2018.
Learned counsel for the petitioner further submits that in the instant case nothing was recovered from the possession of the petitioner. In this case two cartridges and one loaded country made pistol was recovered from the possession of Praveen Singh and Chunchun Singh and not from this petitioner.
Patna High Court Cr.Misc. No.77197 of 2018(2) dt.10-01-2019 2/2 Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail after 21.03.2019 on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Learned Additional Sessions Judge-cumSpecial Judge, SC/ST, Begusarai in connection with Matihani P.S. Case No. 142 of 2018.
