The present application seeks restoration of Cr. Misc.

Patna High Court Cr.Misc. No.40584 of 2015 (5) dt.07-10-2015 2/2 No. 14784 of 2013 which was dismissed on 16.07.2015. The Court has recorded that to an offer made to the learned counsel appearing to assist the Court, he expresses his inability. Learned counsel for the petitioners submits that on the said date he had some personal difficulty and thus requested his colleague to appear in the matter. However, he seeks apology for the counsel not assisting the Court on 16.07.2015 leading to dismissal of the case.

Upon considering the facts and circumstances of the case and submissions of learned counsel for the parties, by way of indulgence, the conduct of the counsel appearing on 16.07.2015 is condoned. Order dated 16.07.2015 passed in Cr. Misc. No. 14784 of 2013 is recalled. Cr. Misc. No. 14784 of 2013 stands restored to its original file and number.
