JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioners and the learned A.P.P. representing the State.

The petitioners seek pre-arrest bail in connection with Raghopur (Rustampur O.P.) P.S. Case No. 103 of 2013 registered for the offences punishable under Sections 147, 148, 149, 323, 448, 380, 307 of the Indian Penal Code and Section 27 of the Arms Act.

On behalf of the petitioners it is submitted that the petitioners have been implicated falsely, there is allegation that the petitioners and others opened 30 round firing, but no injury was found to any one, allegation of theft is superaddition and as such the petitioners deserve sympathetic consideration. Due to land dispute between the parties, this case has been lodged.

Patna High Court Cr.Misc. No.33480 of 2016 (2) dt.20-08-2016 2/2 Learned A.P.P. fairly submits that no injury has been caused to any one.

In the facts and circumstances stated above, the petitioners in case of their arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Raghopur (Rustampur O.P.) P.S. Case No. 103 of 2013, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
