2. The petitioner apprehends his arrest for the offences alleged under Sections 379, 411, 353 of the Indian Penal Code, Section 4(1-a) 21(1) D.E. Act 40(1) B.M. Act and Sections 33/41/42 of the Indian Forest Act registered in connection with Dehri (Town) P.S. Case No. 118 of 2016.

3. It is submitted that petitioner being the driver of the subject truck has been falsely implicated as the goods were carried under the valid Challan from Palamu, Jharkhand to Sasaram on the alleged date of occurrence.

4. Having regard to the entirety of the facts and circumstances of the case, in the event of petitioner's arrest or surrender within four weeks hereof let the above named petitioner be released on provisional anticipatory bail on furnishing bail bond

Patna High Court Cr.Misc. No.31511 of 2016 (2) dt.09-08-2016 2/2 of Rs.10,000/- [ten thousand] with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri-on-Sone, District Rohtas in connection with Dehri (Town) P.S. Case No. 118 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.

5. The provisional bail shall stand confirmed on satisfaction of the learned Court below after verification of the genuineness of the Challan (Annexure-2).

6. The bail petition stands disposed of.
